Felony Habitual Traffic Offender HTO Arrest

Driving while license suspended as a habitual traffic offender is a felony here in Florida. Now, there are ways to fix this felony, and it can be a misdemeanor depending upon the circumstances. But, one thing you don't want to do is you don't want wind up in Circuit Court on a felony driving while license suspended as an HTO because some of these judges are sending people to prison. You face five years prison on this. You're probably not going to get five years, but some of the judges like 18 months prison, some like a year and a day. And, the point these judges are making with people is, "Look driver, what the hell am I supposed to do with you?" "You've had several of these. You now have a five year suspension. You've been caught so many times, now you wind up in Circuit Court. What more can I do to you? You're not getting the point."

Well, I'll tell you what you can do. You should get an attorney. I know it sounds like you're asking a barber if you need a haircut. It's a little self-serving. But, we can really help you thru this, we can really help, really, get the felony removed before you even wind up going to court.

Here's what we're going to do. I want you to go get a copy of your driving record. I mean, the full driving record, not a chintzy little 7 year thing. I want the whole thing. We're going to go over it with a fine tooth comb. We can appeal some of the bad things that are on that record. Some of the things that created the HTO. We can file little appeals on those in the traffic court system while your felony is pending. The hope is, we win some of those appeals before you ever hit the felony Circuit Court. And if we do win, its a beautiful thing. We get your HTO removed. With the removal of the HTO, it will make it very difficult for the state to file felony charges on you. It will make it very difficult for the judge to send you away when you've cleaned up all the problems.

So, your homework assignment is: get a full copy of your driving record. Get with a local attorney that's handled HTO cases before. The way I see this, the road-map for your success on this case is, get an attorney either who will remove the bad stuff and then by the time you get to court they won't even have a felony against you. It will be a beautiful thing. But this is one of those charges that you have to act fast because this process--the appeal process that's going on in the background to remove your HTO--that can take months. So, I wish you luck on your case.
